The WA regulatory landscape
Workplace safety in WA sits under the Work Health and Safety Act 2020 and the WHS (General) Regulations 2022, which commenced on 31 March 2022 and harmonised WA with the national WHS framework. The Act introduced industrial manslaughter — crime offence carrying up to 20 years' imprisonment for individuals and $10 million for body corporates, with a separate simple offence of up to 10 years and $5 million. ISO 45001 is the structured way to evidence the officer due diligence the Act expects.
The resources sector is regulated by DMIRS under the WHS (Mines) Regulations 2022 (replacing the Mines Safety and Inspection Act framework). Most Pilbara, Goldfields and Mid West principal contractors expect certified ISO 45001 systems from their supply chain as a baseline prequalification requirement.
Environmental obligations sit under the Environmental Protection Act 1986 administered by DWER. Prescribed premises require a Part V licence or works approval, and operations in environmentally sensitive areas (the Burrup, the Swan-Canning, the South West) face active scrutiny. An ISO 14001 management system is the cleanest way to evidence the compliance, monitoring and incident response capability DWER expects.
On the quality side, WA Government procurement under the State Supply Commission framework and prequalification schemes (BMW for construction) increasingly lists ISO 9001 (or equivalent) as a baseline expectation for higher-value tenders, particularly across transport, health and METRONET.
